Relationship & Readiness

• We both agree that we want a divorce
• We are willing to cooperate from start to finish
• We can communicate respectfully, even if emotions are challenging
• There is no intimidation, fear, or domestic violence occurring between us
• There are no restraining or protective orders in place regarding us as a couple

Legal Fit

• We are only seeking a California divorce, not a legal separation, not an annulment, not summary dissolution
• There is no existing divorce case already filed in this matter
• We are divorcing based on irreconcilable differences only
• We are not formally represented by attorneys in this divorce (consultation is okay)

Cooperation & Decision-Making

• We understand that all decisions will be made jointly by us
• We are prepared to agree on:
  • - property and debt division
  • - support (if applicable)
  • - parenting arrangements regarding custody and support of minors (if applicable)
• We understand that GDC does not decide issues or provide legal advice for us

Practical Requirements

• We each have our own email address that can be used for this process
• We both have access to a computer, and a printer
• We are willing to print, file, and serve documents as instructed
• We are both comfortable using a computer
• We can, and will follow step-by-step instructions to completion of the process

Time & Commitment

• We are committed to complete the process within one year of registering with the GDC portal
• We understand there are no refunds if we do not complete the process
• We understand California requires a six-month waiting period after service of the Petition for divorce/summons

Clear Expectations

• We understand this is by design a do-it-yourself process with necessary guidance
• We understand GDC does not provide legal representation, legal advice/strategy or any form of legal counsel
• We understand court processing times are outside GDC’s control
